The following is a brief overview of our services:
- Chapter 7 Bankruptcy: Chapter 7 is often referred to as “liquidation bankruptcy,” allow consumers to discharge debts completely through a relatively short process and is the most common type of Bankruptcy. We routinely assist clients in filing and obtaining a discharge of their debts through a Chapter 7 Bankruptcy, which provides a fresh start by wiping out all of our client’s qualifying debts including credit cards, medical bills, repossession deficiencies, law suits and many other debts.
- Chapter 13 Bankruptcy: Chapter 13 is a federal debt consolidation plan which allows clients, with regular income, to rearrange their financial affairs and repay just a portion of their debts. Chapter 13 Bankruptcy offers some advantages over liquidation under Chapter 7, including the ability for home owners to save their homes from foreclosure by creating a repayment plan for mortgage lenders. Another advantage of a Chapter 13 plan is that it allows individuals to re-amortize secured debts (other than a mortgage for their primary residence) and pay them over the life of the Chapter 13 bankruptcy plan. We work closely with our clients and the trustee to obtain a consolidation plan that is structured properly and that achieves our client’s goals.
- Chapter 11 Bankruptcy: Chapter 11 Bankruptcy: We also assist businesses in procuring Chapter 11 Bankruptcy which works similar to Chapter 13 for individuals. Chapter 11 Bankruptcies are very complex because the business owner or company president is required to become the trustee or called “debtor in possession,” which involves numerous responsibilities and duties. In addition, for Chapter 11 Bankruptcy, the United States Trustee is intimately involved in the operation of the business until the case is complete. Chapter 11 thus requires a major commitment by the business owner/president and its attorneys to be done correctly.
